The European Commission, the EU’s executive body, issued a statement detailing multiple breaches of the DSA, the bloc's flagship legislation designed to make online platforms safer and more accountable. The core allegations center on two major areas:
1. Failure to Provide Data Access for Researchers
The Commission states that both platforms have made it unduly difficult for experts to study crucial systemic risks, such as the spread of misinformation/disinformation, the impact of algorithms on children's mental health, and the exposure of users to illegal content.
This access is considered vital for public scrutiny and understanding how these massive platforms affect democratic processes and societal well-being.
2. Deceptive User Interfaces & Flawed Moderation Mechanisms (Meta Specific)
The EU's investigation particularly targeted Meta's Facebook and Instagram, accusing them of using so-called "dark patterns" deceptive design choices that manipulate users.
Regulators claim Meta's mechanisms for flagging illegal content (like child sexual abuse or terrorist material) and appealing content moderation decisions are deliberately complex or confusing. This is seen as an attempt to discourage users from taking action.
Furthermore, the EU asserts that when content is removed or accounts are suspended, Meta's platforms fail to provide users with sufficiently detailed explanations and an effective, user-friendly system to challenge these moderation decisions.
The stakes are exceptionally high. The DSA empowers the European Commission to impose fines of up to 6% of a company's total global annual turnover for non-compliance. Given the annual revenues of Meta and TikTok's parent company, ByteDance, such penalties could amount to billions of dollars.
Meta and TikTok now have the opportunity to review the evidence and offer commitments to address the Commission's concerns. However, if the EU deems their response insufficient, the formal proceedings will continue, potentially leading to the first significant fines under the Digital Services Act.
